CLIENT/USER AGREEMENT FOR SMS/MMS MESSAGING AND TWO-FACTOR AUTHENTICATION (TFA)

This Customer/User Agreement (the “Agreement”) governs the terms and conditions for participation in SMS/MMS messaging and Two-Factor Authentication (“TFA”) services provided by Cogent Group, Inc. (“Company,” “we,” “us,” or “our”). By opting in to receive messages, you agree to comply with this Agreement.
- DEFINITIONS
- SMS/MMS Messaging: Text messages, including multimedia messages (images, videos, and audio) sent to users for informational, marketing, transactional, or security purposes.
- Two-Factor Authentication (TFA): A security process requiring an additional verification step (typically an SMS code) to access an account or service.
- Opt-In: The process by which a user provides explicit consent to receive SMS/MMS messages.
- Opt-Out: The process by which a user withdraws consent and stops receiving messages.
- CONSENT TO RECEIVE MESSAGES
By providing your mobile phone number and opting in, you:
- Consent to receive SMS/MMS messages from the Company at the phone number provided.
- Acknowledge that message frequency may vary and may include, but is not limited to, account notifications, security alerts, promotional offers, updates, and other communications.
- Confirm that you are the authorized user of the mobile phone number provided.
- OPT-IN PROCEDURES
You may opt in to receive SMS/MMS messaging through any of the following methods:
- Website Registration: Checking a consent box when signing up on our website.
- Keyword Subscription: Texting a designated keyword (e.g., “JOIN” or “SUBSCRIBE”) to a specified short code or phone number.
- Customer Service Enrollment: Providing consent verbally or in writing during customer service interactions.
- OPT-OUT PROCEDURES
You may opt out of receiving SMS/MMS messages at any time by:
- Replying “STOP”: Text “STOP” to any received message to unsubscribe immediately.
- Customer Service Request: Contacting our customer support team at support<at>cogentgroup.com requesting removal.
- Account Settings: Updating communication preferences in your user account settings on our website. Upon opting out, you will receive a confirmation message and will no longer receive further SMS/MMS communications unless you re-enroll.
- TWO-FACTOR AUTHENTICATION (TFA)
- Enrollment in TFA is required for certain security-sensitive actions.
- Users can enable/disable TFA in their account settings.
- If enrolled, users will receive a one-time passcode (OTP) via SMS to verify identity.
- The Company is not responsible for any failure in message delivery due to carrier issues or incorrect phone numbers.
- COSTS & CARRIER DISCLAIMERS
- The Company does not charge for SMS/MMS messages, but standard message and data rates may apply per your carrier’s plan.
- The Company is not liable for any fees or charges imposed by your mobile carrier.
- Delivery of messages is subject to carrier limitations and network availability.
- PRIVACY POLICY
- Your phone number and message preferences will be stored securely and will not be sold or shared with third parties, except as required by law.

- LIMITATION OF LIABILITY
The Company is not responsible for delays, failures, or errors in message delivery due to:
- Carrier issues
- Network congestion
- Incorrect user information
- MODIFICATIONS TO THIS AGREEMENT
We reserve the right to update this Agreement at any time. Users will be notified of material changes via SMS or email.
